The Director of Public Prosecutions (DPP) has withdrawn criminal charges against former Eastleigh North Police Station officer Rebeccah Njeri Muraya and Sergeant Abdisalam Ahmed, citing lack of evidence and double jeopardy.
Milimani Chief Magistrate Lucas Onyina allowed the withdrawal, noting the prosecution had admitted it lacked confidence in proving the case.
โIt would be unfair to go through the entire trial process when the prosecution doubts the adequacy of evidence,โ the magistrate ruled.
The two officers were accused of illegally detaining and torturing British national Ayni Hussein Mahammud on December 31, 2021, at Muthaiga Police Station, allegedly to intimidate her from pursuing an assault complaint. They also faced abuse of office charges, which they denied.
After taking plea, the officers petitioned the DPP in February 2025 to review the charges. Deputy DPP Jacinta Nyamosi later advised that prosecuting them would amount to double jeopardy, since they had already faced disciplinary action from the Internal Affairs Unit.
The court discharged both officers under Section 87(a) of the Criminal Procedure Code.
