Three men accused of murdering Kasipul MP Hon. Charles Ong’ondo Were will remain in custody after the High Court in Kibera ruled there were strong reasons to deny them bond.

In a decision delivered on August 14, 2025, Lady Justice Diana Kavedza said the prosecution had proved there was a serious risk of interfering with witnesses, noting that the key witnesses were close relatives and friends of the accused and were now under witness protection because they feared for their safety.

The judge also pointed to the accused’s behaviour in court on June 3, 2025, aiming at the prosecution asked, “Who is this? Who does not want us to be released? We shall believe,” remarks interpreted as death threats.

Justice Kavedza said such conduct, especially in open court, was “an egregious manifestation of calculated and malicious intent to instill fear” in witnesses and officers.

Prosecutors told the court that the murder, committed on April 30, 2025, near the City Mortuary Roundabout, was carried out in an organized and coordinated way.

According to an affidavit by a DCI homicide investigator, the firearm used in the killing was recovered from Edwin Odour Odhiambo, alias Machuani.

William Imoli Shigali, alias Imo, is alleged to have driven the motor vehicle that followed the MP from Parliament, while Ebel Ochieng, alias Dave Calo, allegedly procured a fraudulently registered SIM card to coordinate the murder before disposing it off.

The Director of Public Prosecutions (DPP) had filed an application on June 16 asking the court to deny the suspects bail, saying they might try to influence witnesses, run away before the trial, or endanger public safety.

Two other accused persons Isaac Kuria Chege, alias Kush, and Allan Omondi Ogola will know their fate on 22nd of September during their bond hearing.

The five were charged afresh after the DPP combined separate cases filed in the Kibera and Milimani Law Courts.
